Gauthier, a truck driver, drove a dump truck full of asphalt for the Angelo Todesca Corporation to a highway construction site near a busy intersection. A police officer directing traffic at the intersection was run over and killed by the truck as Gauthier backed up to deliver the asphalt. The back-up horn on the truck was not working. Gauthier and his employer, Todesca, knew the horn was not working, a violation of company safety procedures.
Gautier was charged with various driving offenses. He paid a fine and had his driving privileges restricted. The Commonwealth of Massachusetts charged Todesca with motor vehicle homicide. The jury convicted the company and it was fined $2,500. The appeals court reversed the conviction. The Commonwealth appealed.
