Illinois Tool Works (ITW) has a patent on a printhead and ink container that use unpatented ink
Question:
ITW required its customers to only buy ink from ITW to use with their printheads and containers. They could not buy refill ink from other suppliers, such as Independent Ink, which sued ITW for antitrust violation for improperly tying the sale of ink to the sale of printheads and containers. Did the fact that the printheads and containers were patented give ITW the right to require buyers to buy only their ink, or was that an abuse of the patents that created an antitrust violation?
