McCoy bought an antique pistol from the Old Fort Trading Post for $1,000. Later, the gun was taken from McCoy by the police when they learned that it was stolen property. The police turned the gun over to the rightful owner. McCoy notified the Old Fort Trading Post of what had happened and asked for the return of his money, but the owner of the business refused to give him a refund.
