Windows, Inc., sold windows to a subcontractor, Jordan Panel Systems. The windows were transported by a carrier called Consolidated Freightways and arrived badly damaged. Jordan refused payment. The purchase contract stated:
“All windows to be shipped properly crated/packaged/boxed suitable for cross country motor freight transit and delivered to New York City.” The contract did not use any of the standard INCO shipping terms.
