Chief Justice De Grey and Justice Gould? Since Justice Blackstone believes an action in case would lie against Shepherd, is there really any substantive difference between him and his brethren? Would they have agreed with him that Scott could have maintained an action against Ryal? What would have been the nature of that action? In light of Gibbons v. Pepper, p. 508, supra, would actions of trespass lie against both Shepherd and Ryal?
