Lydia Cruz-Moore, an employee of the nonprofit organization Hispanics United of Buffalo, expressed concerns to fellow employee Marianna Cole-Rivera that she and other employees were not doing enough to help the organization’s clients. In response Marianna posted the following on her Facebook page: “Lydia Cruz, a coworker, feels that we don’t help our clients enough at Employer. I about had it! My fellow coworkers how do u feel?” Four employees responded by posting Facebook comments in which they complained about their working conditions and the volume of work. Marianna and these four employees were fired for their postings on the grounds that the posts could be seen as harassing Lydia, the employee who initially criticized her co-workers, in violation of the company’s anti-bullying policy. Was this firing lawful?
