Lakin sued the Postal Life and Casualty Insurance Company for its failure to pay him, as beneficiary, under an insurance policy on the life of his business partner, Hankinson. Evidence presented at the trial showed that Hankinson had contributed neither capital nor skills to the alleged partnership, that he could not issue partnership checks, and that he could not hire or fire employees. In addition, it was disclosed that Lakin paid the policy premiums and had made no settlement of “partnership” interests after Hankinson’s death.
