When the partnership failed to pay off its account, Flanagan sued Pitman, alleging that his vouching for the partnership’s credit made him responsible for the partnership’s debt. The trial court found that Pitman had exercised control of the business by securing credit for it. Therefore, Pitman was held personally liable for the Flanagan debt. Pitman appealed to the Supreme Court of Alabama.
