Singer-Moser was thirty-nine years old when she had her first cavity. Unfortunately, the dentist treating her for the cavity had to do a root canal procedure. At the conclusion of the procedure, Singer-Moser was left with the shell of her tooth and a filling inside it. A week later, she was eating a hamburger at Carnivoracious, a franchised restaurant in her home town. She bit down on a piece of bone that shattered the remnants of her tooth and dislodged the filling. Now the dentist tells her she must have a cap that will cost $2,500. Her attorney tells her that Carnivoracious should pay for the work. Why?
