Your task is to draft a legally binding employment agreement based on Ontario laws and the scenario below and using what you have learned in class discussions, exercises, and samples that you have been provided.
The scenario below provides you with the pertinent information you will need (wages, duties, benefits, etc.) you must use this information when crafting your Agreement. Do not alter it unless you think it is legally necessary to do so! You are expected to add additional pertinent information, such as expanded job responsibilities, based on your own research!
There is an example contract provided in the course shell that you can use to assist in the development of your assignment some of the provisions will be similar but others will require significant amendments and revisions. DO NOT MERELY COPY THE AGREEMENT AS THIS AGREEMENT IS A GUIDE ONLY.
2 ASSIGNMENT SCENARIO
You have been asked to draft an employment contract for the Employee Relations Specialist role at Heavens Door Community Housing (Heavens Door), an Ontario non-profit organization which provides rental housing (townhomes, apartments, single and semi-detached homes) for low-income families in Waterloo Region. Their head office is located at 25 Union St.
Heavens Door has interviewed several candidates and wishes to present an offer of employment to Sarah House. It is anticipated that Sarah would commence with Heavens Door on October 21, 2022.
Heavens Door is very concerned that its proprietary interests be protected. Sarah should not be able to remove or use any company information or contact any clients of the company after the end of her employment. A few years ago, an employee was terminated for inappropriate behaviour and immediately used company information to start a negative publicity campaign, sending out flyers to supporters in the middle of Heavens Doors most important fundraising event. It cost Heavens Door Community a lot of money in lost event revenue, and they lost some significant grants and donors. Heavens Door wants to do everything possible to avoid a similar situation in the future.
CONTRACT DETAILS
Compensation:
base salary of $120,000 per year paid bi-weekly by direct deposit
bonus plan that will pay Sarah a 5% bonus if the organization is able to decrease its lost-time accident rate by at least 2% annually
three weeks of vacation after 12 months of employment and vacation pay of 6%, with an increase of one week after 5 years.
standard health & dental plan with 80/20 co-pay of premiums
Defined contribution pension plan - the employee contributes 4% of their gross pay and 1% contributed by the employer
Duties:
Sarah will be expected to work a minimum of 40 hours per week plus overtime as needed and as permitted under the ESA.
Reporting to the CEO, the Employee Relations Specialist is responsible for fostering a high functioning, collaborative and innovative culture that embraces diversity and inclusion. The individual will manage the employee relations for the organization including compensation, recruitment and selection, health and safety, discipline, advocacy, and other HR functions as may be required. This role does not have direct supervisory responsibility for employees.
Termination:
Should it be necessary to terminate Sarahs employment (without cause), Heavens Door will provide her with 1.5 weeks of pay at her current base salary in lieu of notice for every year she is employed by Heavens Door.
