1. How much of an equal pay issue do you think there is? Is the pay gap conscious discrimination or the result of differences in negotiation, past salaries, accepting different positions, lost years of experience due to family situations, etc.? How would you close the gap? Discuss these or related issues substantively.
2. Is applying/using a stereotype (gender or race) in a certain situation the same as discrimination? Explain the relationship as you see it and the implications in employment practices and decisions.
3. Though there is a debate as to whether the term alien is improper, it is the definition under the law for "any person not a citizen or national of the United States," so I generally use it until we see a change. As I stated in the audio lecture, Title VII does not explicitly protect " aliens, " but "aliens" enjoy Title VII protections. We also saw where aliens can have causes of action against employers for violations of federal laws, such as the FLSA, even though they were not lawfully here and had authorization to work. Does the law adequately protect aliens?
Do we need to broaden or narrow the protections afforded to them in employment? Also, should we be able to discriminate facially based on citizenship? Discuss these or related issues substantively.
Do use care here, as this is a polarizing topic and could be a sensitive issue for some in this class for various reasons, including whether the policy significantly impacts them or a family member in this area.
