Teacher Contract ARTICLE GRIEVANCE PROCEDURE: A A "grievance" is hereby defined to mean a dispute involving the meaning, interpretation, or application of this Agreement. BFailure at any step of this procedure to communicate the decision of a grievance within the specified time limits to the aggrieved employee and the President of the Association shall permit the aggrieved party or parties to proceed to the next step. C Failure at any step of this procedure to appeal the grievance to the next step within the specified time limits shall be deemed to be acceptance of the decision rendered at that step. D A grievance that affects a group or class of teachers from a different building or department, or is of a general nature, may be submitted in writing by the Association to the Superintendent directly and the processing of such grievance shall be commenced at Level Two. E When a grievance arises, the grievance must be filed within ten l calendar days or when school is not in session, fourteen l calendar days from the day of the event upon which the grievance is based or from the date when the teacher had or should have had knowledge of the event. F Each written statement of a grievance shall include: a statement of the facts constituting the grievance; a reference to the applicable provisions of this Agreement; and the dates of all prior written presentations. Each grievance form submitted by the Association, on behalf of a member, at Level Two or Three shall be signed on behalf of the Association by its President, VicePresident, or the Chair of the Grievance Committee.
If a dispute arises, it will be resolved through two levels: Level One, where a hearing is held within seven days of filing the grievance, and Level Two, where a hearing is held within seven days from the reply. If the dispute is not resolved at Level One, an additional person may be present at the request of either party. The supervisory answer will be transmitted to the Association within seven days. The Assistant Superintendent for Human Resources' answer will be sent to the Association within seven calendar days of a Level Two hearing. If the dispute isn't resolved, a hearing will be held within seven days between the aggrieved employee, the Chairman of the Grievance Committee, and the Superintendent. A Massachusetts Teachers Association representative may be present at this hearing. If the dispute isn't resolved, a hearing will be held at the second regularly scheduled Committee meeting. The Level IV grievance hearing will be scheduled at the first regularly scheduled Committee meeting after the Level III response. The Committee's answer will be sent to the Association within ten calendar days of the hearing at Level Four. If the grievance is not resolved at Level Four or no decision is made within ten days, the Association can refer the unsettled grievance to arbitration within ten calendar days.
The arbitrator is chosen by mutual agreement between parties, or by the American Arbitration Association if no agreement is reached. The arbitrator cannot modify the contract terms. The decision is written and final within days of the hearing. The costs for the arbitrator's services are shared equally by the Committee and the Association. The grievance procedure is not included in a unit employee's personnel file unless requested by the employee. All grievance matters are treated as confidential and not consulted in reemployment, promotion, or transfer decisions. Charges or disciplinary action will be included in the employee's file unless the grievance procedure is used, after which charges will be substantiated.
