will be assigned a role: one as the client representative and the other as

the contractor representative. Your goal is to apply the principles of

negotiation to resolve a conflict that has arisen during the project. Your

tutor will pair you up with one of your classmates; Your tutor will provide

you the brief for the respective roles. You are to video record the

negotiation between the two of you. The negotiation process should take

between $15-20$ minutes. You are required to submit individual report after

the role play is over. You must provide the link to the video in your report

for your supervisor to view it$.$

Scenario:

A dispute has arisen regarding the following:

Project: Construction of a new office building

Issue: There have been unexpected soil conditions encountered during

excavation, requiring additional foundation work.

Contract: The contract includes a clause outlining unforeseen site

conditions, but the specific responsibilities for cost and schedule impacts

are unclear.

i$.$ Prepare for negotiation by researching typical industry practices for

dealing with unforeseen site conditions in construction contracts.

ii$.$ Identify your team's priorities and desired outcomes from the

negotiation.

iii. Develop a negotiation strategy using the principles outlined in the negotiation unit $1.$ iv$.$ Role$-$play the negotiation between the Employer and Contractor

teams.

v$.$ After the role$-$play, debrief and discuss:

$$ The effectiveness of your negotiation strategy.

$$ The challenges encountered during the negotiation.

$$ Possible solutions reached or areas for further discussion.
