I live in the state of New Jersey and I was able to find the disciplinary actions page on the New Jersey Consumer Affairs website under the Professional Counselor Committee section. I was able to find a settlement letter where it states the boundary violations was professional conduct and failure to report abuse. An underage client disclosed to their male counselor that they were being physically abused. The counselor noted the abuse but admitted to failing to report this to the Division of Child Protection. The counselor admitted to having a lapse of professional judgement due to the fact the client was already being monitored for abuse by a case manager from the Division of Child Protection. The counselor also stopped working with clients under the age of 18. The actions that were taken was an agreement to formal reprimand and to cease working with clients under the age of 18. The complaint was filed by the counselors employer. The ethical code that was violated is B.2.a "the general requirement that counsel ors keep information confidential does not apply when disclosure is required to protect clients or identified others from serious and foreseeable harm or when legal requirements demand that confidential information must be revealed. Counselors consult with other professionals when in doubt as to the validity of an exception. Additional considerations apply when addressing end-of-life issues" (ACA, 2014). The laws that were broken were N.J.S.A. 45:1-21(e) and N.J.A.C. 13:34-18(e) which is failure to report abuse from a minor to the Division of Child Protection as required. If a minor disclosed to me about abuse that happened to them, as a mandated reported I would've reported this abuse to the proper authorities as soon as possible. The counselor believed that since the client already had a case manager for abuse from the Division of Child Protection that they did not need to report teh specific events they discussed. Just to make sure all important information was given I would've still reported it.
