b) ABC Bhd. agreed to sell a melting furnace to ASB. Both agreed

that the temperature of the melting furnace must not be lower than 2600 degree

Fahrenheit. There furnace supplied by ABC however did not meet the required

temperature. Advised ASB - 6marks

c) TEM Enterprise ordered 5 sacks of Basmati rice from the RWB

Sdn bhd and the Basmati rice were delivered early this week, Ali the head of

operation at TEM discovered that 3 sacks of the rice had been discolored. as a

result these rice were declared under the health regulation to be unfit for the

human consumption. TEM demand to return back all sacks of Basmati rice that

they received.

d) Arju, a contractor went to Bangladesh to participate in an

international Exhibition of world carpet. He entered into a sale of hand woven

wool carpet by description with a company from Pakistan Ariff Carpet Ltd (ACL).

Arju agreed to buy and ACL agreed to delivery 1000 boxes of 80x120cm carpets.

When the goods arrived, Arju found that the carpets did not correspond with the

decryption. Arju sent an email to ACL to complain on this matter. Meanwhile

when the goods arrived a Port Klang, all were taken from the ship and delivered

to sub purchasers around Klang valley.

Explain whether the element of delivery and acceptance have been

fulfilled in the above case.
