(a) P appoints A as her agent, instructing A to buy an antique car on her behalf costing not more

than RM50,000. A saw a RM100,000 antique car which P had always wanted, on sale for

RM60,000 and bought the car on behalf of P costing RM60,000. P is very upset and refuses to

pay for the car. Advise A under the Law of Agency as to whether P can refuse to pay for the

car. (7 marks)

(b) In the following situations, explain with reference to the relevant sections in the Sales of

Goods Act 1957 when property will pass to the buyer:

(i) C agrees to buy D's car on the condition that D repaints the car. (6 marks)

(ii) M agrees to buy S's motorbike and S agrees with M for payment to be made in the

following month. (6 marks)

(c) DIY Shop put on display 'Genuine leather's' made from Italian leather. Don bought the set of

handbags and discovered later that they were actually made from cow leather from China.

Advice Don whether DIY shop has committed an offence under the Trade Description Act

2011. (6 marks)
