The traditional mudguards are legal in 35 states and specically required by law in Colorado and Missouri. The cost of the specially designed mudguards is five times the cost of the traditional mudguards, but there is some evidence to suggest that the specially designed mudguards are a little safer. a) If a group of truck operators wants to file a lawsuit alleging the law is unconstitutional, what is their best theory to sue under? HINT: because the truck operators are claiming unconstitutionality, the theory they sue under should be a provision in the Constitution that they claim is being violated by the statute. b) Do you believe this Kansas statute is constitutional?
