Advise Kate and Steve as to whether EU law can assist them. Kate is an Irish national
Question:
Advise Kate and Steve as to whether EU law can assist them.
Kate is an Irish national who is married to Steve, who is Canadian, and they live in Italy: Kate works full time as a football manager in Italy. She worked for three years but was fired after a run of poor form. Kate wishes to start training to become a football referee and asks for funding to pay for the course. Applicants are eligible to receive a maintenance grant while doing the course. Her application for a maintenance grant is rejected because she is no longer working and therefore is not covered by the workers directive. After completing the course, she decides to apply for employment as a referee in the Italian Football Federation. Her application is rejected because she needs to pass an Italian culture and philosophy exam that is only required from non-Italian citizens trying to work as referees in Italy. Steve works part-time as an art teacher, and he takes care of the couple's child Mason. Mason has Canadian and Irish nationality. Unfortunately, things do not go well between Steve and Kate, and they get a divorce after two years living in Italy. Steve gets full custody of Mason. The Italian authorities argue that Steve no longer has the right to reside in Italy because he is no longer married.
