Alyssa, a forensic accountant, is asked to provide expert witness testimony at a trial involving insurance fraud.
Question:
Alyssa, a forensic accountant, is asked to provide expert witness testimony at a trial involving insurance fraud. As part of her testimony, Alyssa knows that she will need to perform a business valuation on a local, family owned farm. Alyssa does not have expertise in the farming industry, however she is able to read through appropriate accounting journals to develop her understanding of the market enough for her to complete her work. Assume that Alyssa is capable of obtaining any data that she needs to perform the work and that she is using standard valuation procedures. Explain the rules for allowing expert witness testimony under FRE 702 and FRE 703 (you should do some external research, also note that the FRE are included in the article linked at the bottom of module 1 in the book) AND defend your opinion on whether Alyssa could be considered an expert witness under those rules.
