Question:
Amilia owned a shop selling antique goods. This required her to attend a number of auctions per year. When Amilia went to these auctions her best friend Maya ran the shop. Amilia instructed Maya, that she could sell any of the items displayed in the shop as long as Amilia got at least seventy five percent of the price displayed on the item. Maya was also warned that under no circumstances must she purchase any stock for the shop. While Amilia was away at an auction, Maya sold Ramli an antique clock for sixty percent of the price displayed. Ramli bought the clock believing that Maya owned the shop. Maya also purchased a number of items of jewellery from a collection shown to her by Ramli for RM300. Upon returning from auction, Amilia was furious and told Maya that she would be held personally liable for the losses incurred. Advise Amilia and Maya of their legal positions.
