All Brands store replied that he cannot do that because they have a legally binding agreement and as per the agreement the items purchased during the sales cannot be returned. Questions: 1- A) Does the behavior of the salesperson constitute deception? If it constitutes deception please precise which type of deception and explain in detail all the elements of the type of deception selected. (60 marks) B) Decide, based on the analysis made under A, if Jim and All Brands store have a legally binding agreement in this case. (10 marks) 2- Jim is very worried because he thinks that he cannot prove that the salesperson has confirmed to him that the watch was not previously damaged. He is still a freshman (17 years old) and he does not have enough money to buy another watch in case this one fails him down. Can Jim ask for the contract to be cancelled (so he returns the watch and takes back his money) based on a different legal basis than the Genuine Assent? Please explain. (30 marks)
