Basic Criminal Law

1) A man decides to steal a six pack of beer from a party store. He opens the cooler door and after seeing the clerk look at him he changes his mind and fails to pick up the beer. Has larceny occurred?

2) A two-year-old enters a store with his mother when he picks up a stuff animal without the mother's knowledge. The two leave the store without paying for the animal. Should charges be brought against either the child or mother?

3) A high school senior decides to shoot another person in the school. A friend of his supplies him with a gun. After the shooting, the father finds out and hides the gun from the police. What crimes have occurred?

4) Officers set up a drug buy. During the telephone conversation the person the officer is talking to yells to someone else and asks if the price being set up is o.k. with him. The second subject agrees. The meet is set up and two subjects show up. Officers know the other subject on the phone was the driver of the car. What can this second subject be charged with?

5) A man decided to rob a bank. In preparation for the robbery he steals a car and obtains a gun. He than drives to the bank, enters and robs it before fleeing in the stolen car. Where has an attempted bank robbery occurred? a) Same circumstances as above but this time before stealing the car and obtaining the gun the man agrees with another to rob the bank. Has a crime occurred?

6) A teacher sexually assaults one of his students in 1983. The teacher then moved to Florida in 1987 where he was charged with CSC with a one his student there. After reading the media accounts in 1995, the victim made a complaint in Michigan. Does the statute of limitations prohibit charging the teacher in Michigan?

7) A woman reports that her stepfather forced sexual penetration on her while when she was 14-year- old. She is reporting the incident when she is 35. Can charges be brought?

8) Four subjects watch a woman being brutally attack by a subject without stopping it. Charges?
