Ari and Mas are two scientists with Rocket Resources Sdn Bhd. They have just been given a task by their employer to conduct research on alternative power sources for future use to run machinery. Ari and Mas decided to divide the task between them. Ari would concentrate on solar power and bio-diesel, whilst Mas would research on fuel that could be derived from the wind and waves. In October 2021 they completed the research and published a report for the company. The company decided to publish the report in Energy Future, a scientific journal. Matahari Machines, an engineering company, alleged that certain parts of the report were taken from a similar report which they published in another journal a few years ago. Certain diagrams and charts in Ari and Mass Report were the same as the one contained in Matahari Machines report. Based on the above, answer the questions below:

a) Explain who is the legal authors and owner of the copyright in the report published by Rocket Resources Sdn Bhd. How do you compute the duration of copyright for the said work? (10 marks)

b) Discuss the concept of substantial part which was illustrated by Justice Gunn Chit Tuan in the case of Longman Malaysia v Pustaka Delta Pelajaran (1987) 2 MLJ 359. What must Matahari Machines prove to establish that there was an infringement of their work by Rocket Resources Sdn Bhd? (15 marks)
