ARTICLE $4$MANAGEMENT RIGHTS$($ Help Agency$)4\mathrm{.}01$Subject to the terms of this Agreement, it is the function of the Employer to: Direct the working force. Operate and manage its business in all respects. Hire, select, transfer or lay$-$off because of lack of work. Maintain order, discipline and efficiency and to establish and enforce reasonable rules and regulations governing the conduct of employees, which rules and regulations shall primarily be designated to safeguard the interests of the clients and the efficiency of the service. Promote, demote, discipline, suspend and discharge any employee provided, however, that any such action may be subject to the grievance procedure provided herein.
