As you have learned through lectures and your readings, there can be significant overlap between tort law and contract law. e.g. some promise may have been made in negotiations which is not a term of the contract (and therefore not a breach of contract) or some conduct may take place which is outside the scope of the contract (and therefore not a breach) or a contract may include an exclusion clause which limits the amount of damages for Breach of Contract. Provide an example of when these two areas of law might overlap and give us your thoughts on whether you believe this to be a good or bad thing for plaintiffs and defendants.
