Analyze the American legal system and the sources of law as applied to various aspects of business.

Instructions

• Read the attached court opinion for the State of Arizona v. Tagge (2019).
• Given the template listed below, thoroughly examine the opinion by answering the questions using this "Case Briefing" template below for summarizing and understanding legal cases.
• Refer to Appendix 1 in your textbook on pages 709-710 for additional guidance.
• Refer only to the case facts provided in the textbook. Do NOT do outside research.
• Please Note: This case was decided in 2019 before Prop 207 legalized recreational marijuana use.

Format

• Include a Title page (with the assignment name, your name, PCC class title, instructor name, and assignment due date). The Title page DOES NOT count towards the length of the paper.
• Use the attached template as your guide for this assignment.
• Type your assignment.
• Use full sentences rather than bullet points.
• Keep the length of the assignment to at least 2 pages (500 words), but not more than 4 pages (1,000 words) and it must be double-spaced. Please note that the intent of a case brief is to summarize the important elements of a case.
• Use one-inch margins and Times New Roman 12-point font.

Case Briefing System

You may read more about briefing a case in Appendix 1 of your textbook (pages 709-710). Refer only to the facts provided in the textbook. Do NOT do outside research.

Parties: Who is/are the original plaintiff(s) and the defendant(s)? Who is/are the appellant(s) and the appellee(s)?

Facts: What are the facts of the case? What is the complaint? Is this a civil or criminal case, and how do you know?

Procedural History: Which court is writing the opinion? Is this case on appeal? If so, what lower court heard the case and what did it decide?

Issue: What is/are the legal issue(s) appealed? Is the issue related to a substantive or procedural law issue? (Refer to page 14 in your textbook for further guidance.)

Decision: Which party wins the court decision?

Reasoning for Decision: What rules of law and reasoning does the court use in deciding the issue? (Rules of law are the laws relevant to the case, such as specific statutes, prior cases, regulations, etc.) Take care to explain the court's logic in reaching its conclusion.
