Based on the case below: Adani Power Limited (C): Renegotiating long-term electricity contracts

Assuming that you are a freelance project and procurement expert, you have been approached by Adani Power Limited (APL) for a fee to help them deal with the consequences of the decision made by the Central Electricity Regulatory Commission (CERC) with respect to its application for renegotiating on the electricity contract.

TASKS:

Respond in writing by addressing the following in the report you will submit to APL:

(a) An analysis of APLs position as a contractor and what is expected from them by CERC.

(b) A clear analysis of APLs case within the project contractual framework.

(c) Based on the above, and from a risk perspective, make recommendations on the way forward for APL and justify your recommendations.
