1. Kenetech Windpower held a U.S. patent on a variable wind turbine. Kenetech learned that New World Power (NWP) had recently entered into a contract with Enercon GmbH to purchase turbines that infringed Kenetechs U.S. Patent. The turbines were manufactured in Germany by Enercon GmbH and NWP planned to import them into the United States.

Question to Answer

1) When Kenetech complained about the transaction, NWP argued that U.S. patent laws did not protect Kenetech because the turbines were produced in Germany rather than the United States. Is Kenetech correct? Explain.
