A client comes in and relates the following. She was walking with her infant daughter and passed an apartment building. The client noticed a sign on the building that read "No Pets Allowed In Apartments." As they passed the building a Chihuahua ran out of an open door of an apartment wagging its tail and being chased by the dog's owner. The dog ran toward the child and as a result the child ran away. The child ran into the street. A car being driven by Mr. Smith was speeding down the street and, as a result of his excessive speed, was unable to stop and hit the child, injuring her.
The dog ran over to the child and licked her face.
The manager of the apartment hearing the commotion ran out into the street and seeing the dog and its owner said "I should have evicted him when he got that dog. I knew this was going to happen." The dog owner has been staying in the apartment with his brother, the lessor, since the dog owner was evicted from his previous apartment.
