WEEK 2: CASE ANALYSIS

Each student is to complete his/her own submission of this assignment. The cases are assigned based on what team you are in so that cases are distributed evenly. Each student will treat this as an individual assignment. While it is not required that you meet as a Team/Group it is strongly recommended in order to discuss the details of the case and ensure correct identification of the parties and courts. If you meet as a Team/Group, please indicate this on your slide presentation or paper as, if you do collaborate as a group, each person may write/present his/her assignment from the perspective of either the plaintiff, defendant or Court. Each student in a Team/Group must select different roles if using the collaboration approach. For example: two students in the same Team/Group cannot both be the Court if you fully collaborate.
If you do NOT collaborate as a Group, each student must write/present/ a summary of all perspectives. Your response must be well rounded and analytical and should not just provide a conclusion or an opinion without explaining the reason for the choice. Do not 'cut and paste' the Holding, Issue or Outcome. Restate in your own words.
The assignment should be submitted as a PowerPoint and should include each of the following slides (some questions may take more than 1 slide). In the alternative, you may write a Memorandum/Essay Paper identifying each of the following categories.
Introduction Slide: Your name, course designation, assignment identification, case assigned.
Parties: Identify the original plaintiff and the defendant.
Original Court in which the Case was begun: Where and in which Court was this case first filed.
Parties and Procedure: Which Party Won, Which Party Lost, Which Party Brought the Case to the next level: Did the original Plaintiff appeal the case or did the original Defendant. Remember the identification of the parties' changes when a case moves to the next highest court level. Remember to use the correct identifying term and identify the party by his/her classification in the lower court and his/her role in the higher court.
Court Which Decided the Case: Identify the final court in which this case was heard, i.e. State Appellate, Federal Appellate, State Supreme Court or U.S. Supreme Court.
Facts: Summarize only those facts critical to the outcome of the case. Explain how and why those facts were important to the decision.
Issue: What was the central question or questions of law and fact on which the case turns.
Explain the applicable law(s). Do some research on the laws cited in the case.
Holding and Reasoning: How did the court resolve the issue(s)? Explain the logic that supported the court's decision. Did the last court to hear the case make the final determination or did it return the case to a lower court? If it was returned to the lower court, what was the question that the lower court was directed to rehear?
Legal Research: Research at least one other source. Report something you have discovered about the case, parties, or other important elements from your own research. Remember to include the reference citation.
Conclusion: Summarize the key aspects of the decision and your recommendations on the court's ruling.
