Based on what you learned last week, respond to the following. You are, once again, on the witness stand to testify in a large class action suit. The class is all people annoyed by telemarketers. The plaintiff’s attorney is asking for ten million dollars. Each individual person will get a dollar or two. But the lawsuit is expensive and no lawyer will take it if there is no reward for winning. The defendant is WEANNOYU, a large telemarketing company that outsources most of its work to overseas companies. It is these overseas companies that make annoying phone calls. The WEANNOYU says they cannot be held responsible for the work of the overseas companies.
But you know from Business Law that an act of the agent is an act of the principal. You have been asked to value WEANNOYU by the plaintiffs' attorney Thurgood Marshall, but you are also being held out as an expert in ethics. You explain the value of WEANNOYU. Then, WEANNOYU’s attorney Frank Einstein asks you: "Why shouldn't WEANNOYU be able to do anything it wants to make money?"
