Both open facts and closed facts that are relevant should be identified. Issues should be clearly linked to the facts of the research question.

Memo-Analysis of authorities
Relevant authorities include code sections, regulations, court cases, and revenue rulings that address the tax issues. There should be enough authorities to provide a clear understanding of the issue and interpretation of the law. The analysis of each authority should directly address the issues of the research question.

Memo-Conclusion
There should be one conclusion for each issue. Each conclusion should answer the question as briefly as possible and indicate why the answer is what it is.

Hello tax advisor,
In November of2022I lost my job at the bank, where I had been employed for the past five years. It has been challenging finding the funds to support myself and my son who lives with me full-time. I also am providing financial support for my daughter, who is studying English at San Diego State University. In order to pay the bills, I recently obtained a distribution of $20,000from my401(k).Because I am still only50,I was told by a friend that I might be subject to penalties related to this withdrawal. My friend also told me that sometimes this penalty can be avoided, if the early distribution is related to sickness or a disability. In January of2020 I was diagnosed with asthma. Every year I pay high medical costs related to inhalers and other prescriptions, office visits, and occasional hospitalizations. Not only would I have been unable to fund essentials for myself and my children, without the withdrawal I would not have been able to pay these necessary medical costs. When you have a few minutes free, could you let me know your thoughts about this issue? Does this distribution need to be included in my taxable income? Will there be any penalties assessed on top of the distribution? Does my asthma disability impact these answers in any way? As you know, I dont have funds to compensate you at this time. But when we met at my sisters wedding yesterday, you mentioned that you might be able to provide me with answers to my tax questions anyway?
