Booth v. Lewis involved two suits. In the second suit, the Hawai`i court barred Plaintiff Booth from asserting several claims against Lewis, including breach of contract and emotional distress arising out of their joint drapery business. The court did this because:

a) Plaintiff Booth in the second suit was required to assert those claims in the first suit (in which Lewis had sued Booth) according to Rule 12(a);

b) Those claims in the second suit arose out of the same aggregate of operative facts as the main claims in the first suit;

c) Rule 12(b) mandated joinder of those claims in the first suit; or

d) a and b above.
