Brett, while walking on a footpath, is struck by a cricket ball. The footpath where Brett was hit is adjacent to, but outside, a cricket ground. The cricket ball that struck Brett was hit by a batsman during a game of cricket and the ball travelled over a grandstand before striking Brett on the footpath. Cricket has been played at this ground for over 20 years but only one person, other than Brett, had ever been hit on the footpath where Brett was hit.
