By a trust deed dated 12 June 2020, Mr and Mrs Moniecome established a trust for charity. The trust fund consists of one million ringgit.They made several provisions as follows:

20 per cent of the trust fund for the relief of poverty amongst those who have been severely affected by Covid-19;

After the death of the couple on 1 August 2020, the trustees are to carry out the charitable purposes of the trust However, the children of Mr and Mrs Moniecome claim that the trust deed executed by their parents have failed and thus they are entitled to the one million ringgit.
