C Ltd decided to introduce a computer technology in order to modernise the administration of its business. The company contacted D Ltd, which agreed to send a representative, Peter, to look at C Ltd's operations and advise on the most suitable system. Peter called at C Ltd's offices, and, after a detailed inspection, recommended the installation of Venture system costing approximately $1,000,000. Peter assured C Ltd that Venture had a great track record in Asia, and particularly pointed out that it had been successfully installed by many companies in Singapore. C Ltd was persuaded to buy and the system was installed. After only four months, however, the system began to malfunction, with the result that a number of records were destroyed. The company also found that many of the facilities described in the Venture brochure as being "incorporate into the system", did not work, and that Venture had never been launched in Singapore. Advise C Ltd on whether it has any cause of action against D Ltd
