Legal Resources: FILAD
Purpose
The Fact, Issue(s), Law, Analysis, and Decision (FILAD) is a method to break down the parts of a legal case. By breaking down the sections of a case, it becomes much easier to understand the significance of each case, as it relates to a particular area of law.
Facts or the "background" of the case is found on the first few pages. When writing the facts section of a FILAD, be sure to include the following:
Parties - Who are the people involved in the problem?
What are the parties' roles or occupations?
What are the relationships between the parties?
What are the parties' special characteristics?
Events - What occurred?
When did it occur?
Where did it occur?
What is the nature of the location where it occurred?
How did it occur?
Claims - What are the parties complaining of?
What are the parties claiming?
What are the injuries or harm?
What will the defense to the claim likely be?
Issues
The main issues in a legal case are those that are under dispute by the parties. Sometimes, the court will lay out what the issues are in the case. Issues are most often formulated in the form of a question, beginning with the word, whether. As in the following:
"Whether the employer or representative owed the prospective employee a duty of care."
If the issue(s) of a case are not explicitly stated, be sure to formulate them into a question. Remember, the issue(s) are the main reasons why the parties are in dispute.
Law
This section will include all the relevant law involved in the case. This includes any relevant statues, case law, or regulations. Typically, in a legal case, the judges will refer to specific cases repeatedly throughout the body of the case. Sometimes, the case will identify in particular, which cases were
