Call to mind a "CIVIL litigation matter between two private party litigants (*NOT* a criminal matter and *NOT* a civil regulatory matter where the United States is the plaintiff) pending before a United States federal district court (*NOT* a state court) that (a) you have been involved with in a clinic at your law school, (b) you have used in the past during a trial advocacy or other similar course at your law school, (c) you have read about in one of your classes that you found interesting or compelling, (d) is currently ongoing in the real world as reported in the popular press, or (e) you otherwise know about or can at least cognize. Assume that you are either counsel for the plaintiff or counsel for the defense in the matter. Identify "clearly in your written response which side you represent. In your role as either plaintiff or defense counsel, call to mind either a real or realistically imagined key witness or document custodian for your side of the case (that is, a key witness or document custodian that is your client, an employee of your client, etc. -- *NOT* a key witness or document custodian on the other side of the "v." that might be represented by your opposing counsel). Using the Sedona Conference "Jumpstart Outline" as a guide, imagine interviewing this witness or document custodian on your side of the case about the types and sources of potentially relevant evidence he or she may have in their care, custody, or control, especially including ESI.
