Question 2 Max went to an antique items exhibition last week and saw an antique vase from China made in 1828. He offered to buy the vase from its owner, Mr Kardashian, for RM [0,000. Mr Kardashian agreed to that price and said that it would be delivered to Max in three weeks' time. Max offered to pay him a deposit of RM 1000 but Kardashian refused saying that a deposit was not necessary and that the full purchase price could be paid upon delivery. However, Max did not hear from Kardashian and therefore he telephoned Kardashian to enquire about the delay in delivery. Kardashian replied that he had made a mistake as to the true value of the vase. He said that the market value of the vase was RM 30,000. Further, he had already sold and delivered the vase to another person, Ray, who had offered RM 35,000 for it. (a) Advise Max whether Kardashian can avoid liability for breach of the contract for the sale and purchase of the vase on the ground that the consideration was inadequate (12 marks)
