I. Introduction
[1]This appeal raises the difficult issue of situating a tort in order to establish jurisdiction. Ms. Gulevich, her husband, and Her Majesty the Queen in Right of Alberta as represented by the Minister of Health and Wellness commenced an action in Alberta alleging, among other things, negligence on the part of the respondent physician who at the relevant time resided and practiced in Ontario. The appellants obtained an order for service outside Alberta (formerly, ex juris). When the respondent was served in Ontario, he applied to set aside service. The chambers judge granted the application.
