Case Study 3: Written and Verbal Communication Termination

The residency appeal hearing for Pedro Rosario is coming up at the IAD in four days. Pedro has not paid the remainder of the advance payments owing to his immigration consultant, Monica, as outlined in their service agreement. The last instalment was due 30 days ago. Therefore, Pedro is in breach of his obligations under the service agreement. Monica has just realized this when she was preparing for the hearing. She is wondering what to do.

Monica gets out the Code, and turns to Sections 34, 35 and 36 regarding the possibility of terminating her relationship with Pedro.

Discussion Questions

Groups 1 & 2: Most likely, Monica does not have the option to terminate her service agreement with Pedro at this point and will have to represent him at the hearing. If you agree, explain why, with reference to the Code. If you disagree, make an argument why she would be permitted to end her relationship with Pedro considering sections 34 and 35 of the Code.
