Consider this. A man dining in a restaurant experiences a heart attack. The staff immediately calls 911 but ignores a nearby emergency defibrillator. They remain with the guest until the ambulance arrives. In this case, has the staff has done everything that can reasonably be expected to do? They sought emergency help but did not render first aid. Have they met a reasonable standard of care?

 

Provide an explanation of Good Samaritan law for the state of California. Following the explanation, identify and discuss how that law may be relevant within hospitality operations. If possible, provide a court case for that state which involves determining if the Good Samaritan law was applicable.
