XYZ Company conducts business by producing beauty products. The company has been operating in Malaysia for 10 years and has a staff of 1000 workers. During these 10 years, the workers of XYZ company have always complied with the company policy made by the human resources department without any objection Lately, only 50 workers are dissatisfied with the annual bonus. They had formed a trade union on February 10, 2022. However, 30 workers had withdrawn from participating in the formation of the trade union. The leader of the trade union still registers the union with only 20 union members. Form B was submitted on February 25, 2022 to DGTU and the registration process took 2 weeks from the submission of the form. After 2 weeks the trade union has obtained a valid registration certificate (Form D) by the DGTU. With the registration of this trade union, the employer also gives recognition to the trade union However, some workers began to be sceptical of the policies provided by the company. One of the issues that highlighted by workers are annual bonus. Giving bonuses to employees is unfair because the employer only gives bonuses to workers according to annual attendance without evaluating the work performance of workers. This dissatisfaction has led trade unions to invite employers to discuss the bonus issue. While waiting for feedback from employers regarding the annual bonus discussion, a total of 15 members have withdrawn from the trade union. The reduce of union members is not an obstacle for the leader and other members of trade union to invite the employer to hold the discussion. After a few days, the employers decided to reject the invitation from trade union to do discussion regarding to bonus issue. This rejection driven the trade unions to refer to the Department of Industrial Relations Malaysia Questions 1. Is trade union registration at XYZ Company legally valid?
