Material participation is a test to evaluate whether a taxpayer has materially participated in the trade business rental or other incomeproducing activities There are seven material participation tests and the taxpayer is said to have materially participated if he or she passes one of the tests Material participation can be defined generally as a regular continuous and substantial activity of incomeproducing The incomeproducing actions in which the taxpayer materially participates is an active income or loss An active loss is deductible but not a passive loss We have an active and passive participation in income producing activities Above defined material participation is also including as active participation A passive participation in the activity that fails to pass the tests of active or material participation It limits the deductibility of any passive loss unlike the material participation where the loss can be deducted Seven types of material participation tests are 1 the First test is that the taxpayer has participated in the incomeproducing activity for more than 500 hours per year 2 the Second test is the Activity that constituted all participation substantially 3 the Third test is that the taxpayer has worked for at least 100 hours if no other shareholder has worked for more than that 4 the Fourth test is that if the taxpayer has several activities and spend more than 100 hours in each activity and the total hours for all activities add up to more than 500 hours then the taxpayer is treated as a material participant in each activity This is called a significant participation test ...
