ANSWER:

Yes, it is prevalent. In my own understanding a breach of contract is characterized by the failure of one party to fulfill his or her legal obligation to the contract. Sometimes, parties enter to a contract without full information about the context of the contract, only to realize when it is too late to fulfill their obligation to the contract. In such a case, one party is unable to honor the contract due to negligence, which can be resulted to misconduct. Another case is that some parties enter the contract with an intention of committing fraud against the other party. When a party to the contact commits a misconduct intentionally, the law cannot prevent such cases because the party had already weighed the consequences of his or her actions and still decided go on and dishonor the contract.
