Dr. Feelgood is a neurologist who practices in rural Virginia. Because of financial difficulties for the local health system, there is no radiology center in town, and the closest one is 1 hour away. Radiology centers perform scans like CT, MRI, and PET, which can be useful for seeing inside the skull. Vince is experiencing severe headaches and the occasional loss of consciousness (luckily never while driving or operating heavy machinery!). He decides it's high time to see a physician, and makes an appointment to see Dr. Feelgood. At his office, Dr. Feelgood takes a patient history, asks Vince detailed questions about his symptoms, and decides that Vince needs an MRI scan so that he can see whether there are any abnormalities or tumors in Vince's brain. MRI referral in hand, Vince decides that since the radiology facility is an hour away he can wait a bit until he can get some time off of work. He ends up getting the MRI 3 months after his visit with Dr. Feelgood. The scan shows a growing tumor that is causing both his headaches and loss of consciousness. Vince makes an appointment to see Dr. Feelgood shortly after the scan is completed. Dr. Feelgood examines the scan and tells Vince that if he had been able to get the scan and return to Dr. Feelgood sooner, he would have been able to operate to remove the tumor. However, now the operation is more risky and the likely result is permanent brain damage. Dr. Feelgood believes that it would be improper to perform the surgery. Vince doesn't obtain a second opinion and dies 6 months later. Vince's spouse files a complaint for negligence, claiming that Dr. Feelgood failed to find the tumor earlier when it would have been more operable, and that his failure to perform the surgery despite the risk was also negligent. 1. As the attorney for Vince's spouse, what kind of evidence would you want to present, and what are the biggest barriers to your case? Dr. Feelgood is a neurologist who practices in rural Virginia.
