Question 1
Jenny is a 16th year-old girl, who entered into a contract with James as a dancer, to perform at his Night Club every weekend for seven years. The terms of the contract provide that Jenny was not allowed to get married and could not enter into any other contract without James consent. The contract further provided that James can terminate their contractual relations anytime if Jenny did not adhere to the terms of the signed agreement.
Jenny subsequently accepted another dancing engagement at Raymonds night club without James consent. James subsequently spoke to her on the matter and indicated that he would seek redress for her breach of contract.
Advise Jenny. (10 marks)
Question 2
The manager of BP Petroleum Company limited is seeking police protection for the duration of a strike, called by the Trade Union, who are protesting for increases in emoluments for their members- employees of BP. The Police suggested that a mobile patrol would be adequate, but the HR manager of BP insisted on permanent police presence, because of pending lawlessness by strikers. The manager then offered to compensate the Police, if they agree on a permanent Police presence on site, during the strike period.
The Police agreed to provide 10 officers at a rate of $500 per day, per officer, which they will maintain during the entire strike period.
BP later agreed with the Trade Unions demand for increase emoluments and the strike was called off after 5 days. The Commissioner of Police within a week sent an invoice to BP for the 5 days that the Police provided protection.
However, BP refused to pay, and argued that the Police are under a duty to protect the company from any pending violence and lawlessness. Advise the Police on this matter. (10 marks)
Question 3
Jim and Jane got married last Sunday. The next day they travelled to Extended Stay Hotel in Miami for their honeymoon. They arrived at the Hotel, checked in and proceeded to their room. At the back of the front door in their room was a notice excluding liability, which read that Extended Stay will not be responsible for articles lost or stolen, unless it is logged at the front desk for safe custody. However, this exclusion clause could only be seen after the door is closed as well as, the actual notice was small and colored in black, with a white background.
Regrettably, with all the excitement of their honeymoon, both Jim and Jane did not even notice the exclusion clause at the back of the door. One day when they were out shopping, someone came into their room and stole Jims laptop.
Jim reported the theft to the hotel, but the Hotels Manager pointed to the exclusion clause at the back of the door in their room, which provide that the hotel will not be responsible for items lost, if it is not logged at the front desk.
Advise Jim and Jane on this matter. (10 marks)
Question 4
Jill is a known prostitute, rented an apartment from Jacob. Jacob is unaware of Jills profession and gracefully rented the apartment which was unoccupied for the last year.
Jacob saw several people coming and going from the apartment but was not concerned because he thought that they were all Jills friends. Indeed, Jacob was a private person who paid little attention to other peoples activities. He focused on his tasks and that of his family.
Jill did not pay her rent for 3 months and Jacob sought to enforce the right to terminate the rental agreement and sue for the outstanding rent. Jill has indicated that she will not pay any outstanding rent and told Jacob that his contract with her was illegal bearing in mind that she was using the apartment for the illegal purpose of prostitution. Advise Jacob on this matter. (10 marks)
