Landlord Tom Jones leased an apartment to Deleila Smith beginning January st for $ per month, a leased being signed in December. Smith moved in on January st and shortly thereafter noticed there was a mouse infestation in the apartment. On January th Smith emailed Jones explaining the problem. Jones replied the next day, instructing Smith to purchase mouse traps and to deduct the cost from Februarys rent.
Smith used the mousetraps, caught a few mice, but the infestation seemed to only increase, with her noticing mice consistently running throughout the apartment. She also was finding mouse droppings in all of the rooms. On February nd Smith emailed Jones a second time and explained that despite the traps, the mice infestation seemed to be getting worse, that it was an unsanitary living situation and demanded that Jones hire a professional exterminator. Jones replied the next day, stating that exterminators were too expensive and he would not hire one, but that Smith could purchase other types of traps and deduct the cost from the March rent. Smith replied to his email, stating that if the apartment was not professionally exterminated by February th she would be moving out and would no longer pay rent. No extermination took place and Smith moved out on February th ceasing to pay any further rent.
Jones was not able to rent the apartment for the months of March, April and May. He is now suing Smith for $ for the rent for those three months. The lease says nothing specifically about infestation. Will Jones be successful? This is under Illinois law.
