Early one morning, Tom was driving his tractor at 4 a.m. on a road near his northern Ontario farm. Both the weather and driving conditions were excellent. Tom was driving at a normal speed when he fell asleep, crossed the median, and hit an oncoming car head-on. The driver of that vehicle

was killed instantly. An autopsy of the victim indicated that he had a lot of alcohol and drugs in his body at the time of death. Tom is now charged with dangerous operation of a conveyance causing death contrary to s. 320.13(3) of the Criminal Code.
