Stephen was employed as a security guard by Excel Sdn Bhd (“Excel”) one of his jobs entailed patrolling a busy warehouse owned by Excel. One night as Stephen was patrolling the inside of the warehouse, he did not notice a box that was placed in an precarious position on a very tall shelf. As a result when he was waiving his torchlight around to view his surroundings, his hand struck the shelf and the box fell on him.
Stephen fell to the ground and could not move. Luckily his shouts for help were heard by some workers, working late and he was rushed to Lucky General Hospital (“Lucky Hospital”). Upon arrival at the hospital, the junior doctor on duty, Dr. Jekyll, examined Stephen, he prescribed some painkillers for Stephen’s shoulder and back, told him to rest for a couple of days and sent him home.
The next day Stephen found that he could not move. Upon being rushed to Lucky Hospital again, scans revealed that Stephen had not only injured his shoulders but had fractured his back, which may lead to paralysis.
Advise Stephen on what action if any, he can take against, Excel, Dr. Jekyll and/or Lucky Hospital.
